SAWA TERMS AND CONDITIONS

  1. INTRODUCTION

1.1 These Terms and Conditions (“Terms”) govern your use of the Sawa application (“App”), website, and services provided by NISR LLC (“Sawa,” “we,” “us,” or “our”).

1.2 By downloading, accessing, or using Sawa, you agree to be bound by these Terms. If you disagree with any part of these Terms, please do not use our services.

  1. DEFINITIONS

2.1 “User” refers to any person who accesses or uses the Sawa App.
2.2 “Merchant” refers to any business listed on the Sawa platform.
2.3 “Service” refers to all services provided through the Sawa App.
2.4 “Content” refers to all information displayed on the App.

  1. ACCOUNT REGISTRATION

3.1 Users must provide accurate, current, and complete information during registration.
3.2 Users are responsible for maintaining the confidentiality of their account credentials.
3.3 Users must be at least 15 years old to create an account.
3.4 One mobile number can only be associated with one account.

  1. USE OF SERVICE

4.1 Users agree to use the Service only for lawful purposes.
4.2 Users shall not:

  • Violate any applicable laws or regulations
  • Impersonate others
  • Submit false or misleading information
  • Attempt to gain unauthorized access to the Service
  • Use the Service for commercial purposes without our consent
  1. MERCHANT LISTINGS

5.1 Sawa does not guarantee the accuracy of Merchant information.
5.2 Prices, availability, and other details are maintained by Merchants.
5.3 Sawa is not responsible for Merchant services or products.

  1. BOOKINGS AND RESERVATIONS

6.1 Bookings are subject to Merchant availability and confirmation.
6.2 Users must arrive at the specified time or risk losing their reservation.
6.3 Cancellation policies vary by Merchant.

  1. PAYMENTS AND REFUNDS

7.1 Payment Methods

  • Credit/Debit Cards (Visa, MasterCard)
  • Apple Pay
  • STC Pay
  • Local Bank Cards
  • Other digital payment methods as available

7.2 Payment Processing

  • All payments are processed securely through licensed payment gateways
  • Transactions are in Saudi Riyals (SAR)
  • Service fees, if any, will be clearly displayed before confirmation

7.3 Refunds

  • Refund eligibility depends on the Merchant’s cancellation policy
  • Processing time: 7-14 business days
  • Refunds will be issued to the original payment method
  • Service fees are non-refundable unless required by law

7.4 Cancellation Fees

  • May apply as per Merchant policy
  • Will be clearly communicated during booking
  • Vary based on timing of cancellation
  1. INTELLECTUAL PROPERTY

8.1 All content and materials on Sawa are protected by intellectual property rights.
8.2 Users may not copy, modify, or distribute our content without permission.

  1. PRIVACY

9.1 Our Privacy Policy explains how we collect and use your information.
9.2 By using Sawa, you consent to our data practices as described in the Privacy Policy.

  1. LIABILITY LIMITATIONS

10.1 Sawa is not liable for:
– Merchant service quality
– Accuracy of information provided by Merchants
– User-generated content
– Indirect or consequential damages
– Service interruptions

  1. MODIFICATIONS

11.1 We reserve the right to modify these Terms at any time.
11.2 Continued use after changes constitutes acceptance of modified Terms.

  1. TERMINATION

12.1 We may suspend or terminate accounts that violate these Terms.
12.2 Users may delete their accounts at any time.

  1. GOVERNING LAW

13.1 These Terms are governed by the laws of the Kingdom of Saudi Arabia.
13.2 Disputes shall be subject to the exclusive jurisdiction of Saudi Arabian courts.
